Mezei Photography Services Agreement

AGREEMENT/JURISDICTION:

The person(s) whose signature(s) appear on this contract, known as "Client", agree that Kaila Mezei, known as "Photographer", shall provide services to photograph their photo session to the best of her abilities, in the manner described in this document. This is a binding contract which incorporates the entire understanding of the parties, and any modifications must be in writing, signed by both parties, and physically attached to the original agreement.

PAYMENT:

Client shall reserve the time and date of services by signing and returning this contract along with a non-refundable, non-transferable reservation retainer equal to $25 of the total photography fee. No date is reserved until the contract and retainer are received. The balance due for the photography services must be paid in full 48 hours prior to session unless otherwise agreed. 

CANCELLATION/RESCHEDULE:

If for any reason the client decides to cancel or not show up to their schedulded session the full amount of the retainer is non-refundable. Any monies paid is also non refundable .

Client acknowledges and agrees that Cancellation or not showing up by Client will not result in a refund of any fees paid on or prior to the date of Cancellation by Client. No refunds .

Any NO SHOWS or last minute cancellations (less than 48 hour notice) will be required to pay a 25$ rebooking fee and full payment for future shoots. For any cancellations/rescheduling 5 day notice must be given in order to move deposit/retainer . $25 rebooking fee may apply for future shoots. Retainer/deposit can be moved when notice is given and must be used within 6 months of original booking. Must be used towards a new booking and not an existing one where a retainer has already been paid. Rebooking package must be of equal or great value .A new contract may be required. The new package price will reflect pricing in effect when the date change occurs.

LATE

You must be on time for your session. Give yourself extra time for parking. Aim to arrive 15 minutes early. If you are late it goes into your session time . No compensation is given. If you are late this may result it not having time for outfit changes, additional photos taken etc . Additional fees apply if additional time is needed and if it is possible.

LIABILITY:

If Photographer is unable to perform any or all of the duties herein for any reason, including but not limited to, fire, transportation problems, acts of God, accident, illness, or technical problems, and if she cannot provide another competent professional, all money received by Photographer, minus expenses, will be returned to Client, and Photographer shall have no further liability with respect to this agreement.

Failure to Deliver . Photographer shall not be held liable for delays in the delivery of such Work Product, or any Work Product undeliverable, due to technological malfunctions, service interruptions that are beyond the control of Photographer. The photographer is not responsible for the quality of photo centre prints

Photographer is not responsible for any injuries, accidents of any kind, sunburns, choking or any illness that may occur. Photographer is not responsible for any lost or stolen items at any of our locations that are attended. Photographer is not responsible if the client or individuals fail to appear, attend late and/or uncooperative during the session. Photographer is not responsible for how photos turn out due to outfit choice, decoration choice, and children’s behaviour and/or weather occurring.

 If anyone involved in the session disagrees with the agreement the client assumes responsibility for any liability. Photographer has the right to cancel any session should there be any disruptions. Photographer will also not proceed with any clients when felt necessary. Photographers camera is the only camera to be sued during the session.

IMAGE ARCHIVE:

All images will be available for download for 1 month following the session date. Client is responsible for downloading their images in a timely manner. The Photographer cannot guarantee the images will be kept beyond a 12 month period. A 75$ re upload fee may apply.

The UNEDITED photo gallery will be sent via PIXIESET to the email provided, each client has 21 days from original sending date to choose images. All edits will be based on clients’ choice of photos. Photos MUST be chosen in 21 DAYS –if you DO NOT choose within 21 days there will be a charge of $75 to re-upload. Standard re-touching is included in every photo session. Complex retouching consist of hair colour change, large bags or purses removed, clothing discrepancies, stuffed animals removed, large scarring, body shape and anything to do with laugh lines or wrinkles. Complex retouching is an additional charge it is not included in a standard retouching package. The photographer is not responsible for the quality of photo centre prints.

COPYRIGHT:

The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer's website, social media and / or studio.
